Sigma International Cleared in CareFusion Patent CaseFebruary 13, 2012
Earlier this week, the federal jury in San Diego cleared Sigma International from CareFusion’s patent infringement lawsuit. CareFusion filed a patent case against Sigma International General Medical, LLC over the technology used in its Spectrum infusion pumps.
Initially, Carefusion filed a complaint last February 2010 against Sigma International. Sigma responded by asking for declaratory judgment of non-infringement and invalidity. After a Patent Office reexamination, the case was moved to San Diego for a federal jury to decide.
CareFusion was reported to have asked the jury to award them 172 million dollars for damages and lost profits from competing infusion pump products. After a two-week trial, an eight-man jury ruled in favor of Sigma International. The federal jury was convinced that Sigma International did not infringe the sensor component of CareFusion’s infusion pumps, thereby allowing Sigma to continue the manufacture and distribution of its Spectrum infusion pumps.
